SUPREME COURT REIGNS IN EXECUTIVE BRANCH
The Supreme Court ruled that the EPA exceeded its authority when it sought to cap carbon dioxide emissions from West Virginia coal plants – a decision that will strongly limit the executive branch’s authority to make policy without Congress passing a law to give it that authority.
The small picture: The Supreme Court ruled 6-3 in West Virginia v. The Environmental Protection Agency (EPA) that Congress did not grant the EPA authority to enforce emissions caps on coal power plants. This dispute goes back to 2015 when Obama created the Clean Power Act to fight climate change. Justice Roberts wrote the majority opinion, which states:
“…it is not plausible that Congress gave EPA the authority to adopt on its own such a regulatory scheme in Section 111(d). A decision of such magnitude and consequence rests with Congress itself, or an agency acting pursuant to a clear delegation from that representative body.”
The medium picture: This is a major setback for Joe Biden’s climate change agenda. The Supreme Court said the Executive branch has no authority to force through a national climate change policy without authority from Congress.
Since taking office Biden implemented policies geared towards making traditional energy less affordable in an attempt to drive Americans towards green energy.
This is not unlike what Biden’s been doing with gasoline. He’s making the price so uncomfortable in order to push Americans towards electric cars.
The big picture: This was a push back not just to the EPA, but to the FDA, HHS, and every other federal agency filled with un-elected bureaucrats like Dr. Fauci that think they have the power to create laws by fiat to control you. This ruling reinforces that their role is to serve the people and do nothing more than carry out the laws that our elected representatives pass.
