SENATE PASSES GAY MARRIAGE BILL

The Senate voted to advance a bill that would codify same-sex marriage rights into law.

A dozen Republicans joined Democrats to pass the bill 61-36, while other members of the GOP argued it will infringe on religious rights.

The details: The bill, called the Respect for Marriage Act, repealed the Clinton-era Defense of Marriage act that defined marriage as between a man and a woman. Notice the DEMOCRATIC Bill during the Clinton Admin was the restrictive bill. The new bill requires that marriages are recognized regardless of “sex, race, ethnicity or national origin.”

Back up: The Supreme Court already ruled in 2015 [Obergefell v. Hodges] that same-sex couples have a constitutional right to marry. But when the court over-ruled Roe v. Wade this past summer, Justice Clarence Thomas said it should review Obergefell in future rulings.

This prompted Democrats in Congress to draft legislation on same-sex marriage.

Public sentiment: A poll in May from Gallup found that 71% of Americans say they support gay marriage.

That’s up from 27% in 1996.

GOP opposition to the bill centers around the concern that this bill will open up religious groups to having their tax-exempt status taken away by the DOJ and IRS if they object to hosting same-sex marriage ceremonies.

Leaders in the Catholic church like Cardinal Timothy Donal echo the GOP opposition, saying that faith-based groups like adoption providers, foster-care providers, and religious employers “are all at greater risk of discrimination under this legislation.”

Senators Mike Lee, Marco Rubio, and James Langford all proposed amendments to the bill to strengthen religious liberty concerns, but were voted down.

Big picture: The First Amendment of the Constitution says: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof”

What happens next? The bill will go to the House for a vote, where it will likely pass. And then Joe Biden will sign it into law. (Note that Trump would have signed this bill with no issue as well)
