SCOTUS ENDS BIDEN’S MANDATE FOR BUSINESSES

Great news: The Supreme Court blocked Joe Biden’s federal vaccine mandate for private businesses with 100 employees or more. The court ruled that the mandate was an “unconstitutional” overreach of power by Biden. The ruling saves nearly 85 million Americans from the illegal mandate.
The ruling was 6-3 with Kagan, Sotomayor, and Breyer dissenting.
Justice Gorsuch said: “The question before us is not how to respond to the pandemic, but who holds the power to do so.
The answer is clear: Under the law as it stands today, that power rests with the States and Congress, not OSHA.
Bad news: The court allowed Biden’s vaccine mandate for healthcare workers to remain in place. The mandate affects workers at healthcare facilities that accept Medicare and Medicaid since they are federally issued. The ruling will affect nearly 10 million Americans.
The ruling was 5-4 with Thomas, Alito, Gorsuch, and Barrett dissenting.
Justice Kavanaugh voted with the liberal justices, saying: the federal government had the power to “maintain and enforce an ‘infection prevention and control program designed … to help prevent the development and transmission of communicable diseases and infections.’”
Perspective: This would be a good time to appreciate former President Donald Trump. Had he not defeated Hillary Clinton in 2016, Barrett, Gorsuch, and even Kavanaugh would not be on the court. Instead, we’d have radical liberals who would have undoubtedly voted with the three other radical justices to allow this extreme federal overreach to take place.
